Dear Customer, In accordance with legal information and disclosure requirements, we hereby provide you with all facts relating to the conclusion of the contract and the processing of your order. I. Cancellation policy Right of cancellation You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of cancellation, you must inform us Rombach und Haas Sommerbergstr. 2 D-78136 Schonach Email: info@rombachhaas.de by means of a clear statement (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires. Simply returning the goods is not sufficient for cancellation. III. Consequences of revocation If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your revocation of this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods! Information on return shipping costs: Most cuckoo clocks can be returned for €10. However, some cuckoo clocks must be shipped as bulky goods. In this case, the return shipping costs amount to approximately €30. Of course, you can also organize the return shipment yourself. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality. IV. Information on individual contractual provisions: We deliver exclusively on the basis of our General Terms and Conditions. Warranty for defects: In the event of material defects that are equivalent to the delivery of another item or an insufficient quantity, we provide the following warranty under the following conditions: 1. If you are a merchant, the obligation to inspect and give notice of defects under § 377 HGB (German Commercial Code) applies. 2. In the event of a justified and timely complaint, we shall be entitled, at your discretion, to remedy the defect or deliver a replacement within a reasonable period of time (subsequent performance). In the event of subsequent performance, we shall be obliged to bear all expenses necessary for the purpose of subsequent performance, in particular transport, travel, labor, and material costs, insofar as these are not increased by the fact that the goods have been taken to a location other than the customer's registered office or branch office, unless this corresponds to their intended use. 3. If the subsequent performance fails at least twice, you are entitled, at your discretion, to withdraw from the contract or to demand a corresponding reduction in the purchase price (abatement); if we are responsible for the breach of duty, you can claim damages. If the material defect is not significant, you are only entitled to abatement. The same applies in the case of an incomplete delivery, unless you can prove that it is unreasonable for you to adhere to the contract due to the incomplete delivery. 4. Technical steps for concluding the contract - Error correction To order an item, enter the desired quantity in the “Quantity” field on the respective product page and click on the shopping cart icon. The item will then be saved in your shopping cart. Once you have selected all items, click on ‘Products’ > “My shopping cart” in the main menu. You will then see your entire order. If all items are correct, please click on “Checkout” to complete your order. To change the quantity, enter the corresponding number in the ‘Quantity’ field and click on “Update.” If you want to delete an item, enter “0” as the quantity in the corresponding line. Now it's time to register. If you're a new customer, click on “I'm new to the Wiha online shop” and fill out the form. If you're already registered, you can log in to the shop directly with your email address and password. You also have the option to correct your personal data at this point. You can pay for your order by credit card (Visa or Mastercard) or on account. On the following overview page, you have the option of entering a different delivery address or correcting the items in your shopping cart.
